Welcome to Kiddos Books, a sub-product of Kiddos AI, developed and powered by Kiddos LLC.
These Terms of Use apply to your access and use of Kiddos Books, including related services (collectively, the "Mobile Application").
These Terms form an agreement between you and Kiddos LLC, a California limited liability company. Use of this Mobile Application is conditioned upon your approval of all terms and conditions expressed here, including provisions about resolving disputes through arbitration.
By downloading, installing, or using the Mobile Application, you agree to these Terms.
1. Registration and Access
The Mobile Application is available only to users who reside in the United States or its territories. You are responsible for all activities that occur during both the free trial and any subscription period. If you access or use the Mobile Application on behalf of another person or entity, you represent that you have the authority to accept these Terms on their behalf.
Use of the Kiddos Books Mobile Application through Apple's App Store is governed by Apple’s Media Services Terms and Conditions.
Payments, refunds, and in-app purchases are managed by Apple and are subject to Apple’s terms: https://www.apple.com/legal/internet-services/itunes/dev/minterms/.
1.a. Business Use
If you purchase, install, or otherwise use the Mobile Application on behalf of a company or organization, you represent that you have authority to act on behalf of that entity, and that such entity accepts this Agreement.
1.b. Content and Connectivity
Content and feature availability may vary depending on your region and may change over time.
A stable internet connection may be required to access or download some books; data charges may apply based on your internet service provider's plan.
2. Parental Responsibility
You must be at least 13 years old or the minimum age required in your state to consent to use the Mobile Application.
Children under the age of 13 may use the Mobile Application only if enabled by a parent or legal guardian, in compliance with the Children's Online Privacy Protection Act (COPPA).
Parents or legal guardians must review and consent to these Terms on behalf of their children.
3. Usage Restrictions
You may not:
Use the Mobile Application for any illegal purpose.
Use the Mobile Application in a way that infringes upon others' rights.
Modify, copy, lease, sell, or distribute the Mobile Application or its contents.
Attempt to reverse engineer or discover the source code or underlying components of the Mobile Application, except as permitted by law.
Interfere with or disrupt the operation of the Mobile Application.
Share Mobile Application content with individuals outside of your authorized use.
4. AI-Generated Content and Third-Party Materials
Some of the books, illustrations, descriptions, and features provided through the Mobile Application are created or enhanced using artificial intelligence (AI) technologies.
While Kiddos LLC strives to maintain the highest standards of quality, creativity, and appropriateness, AI-generated content may not always be free of errors, inconsistencies, or inaccuracies.
We disclaim any responsibility for the accuracy, completeness, or appropriateness of AI-generated content and do not guarantee that all materials will be suitable for every audience.
By using the Mobile Application, you acknowledge and accept the use of AI in content creation and agree to use your own discretion when selecting books and experiences for your child.
The Mobile Application may also link to third-party resources. Kiddos LLC is not responsible for third-party content and disclaims liability arising from your use of such materials.
5. Feedback
We welcome your feedback!
By providing suggestions, ideas, or comments, you grant Kiddos LLC permission to use your feedback without obligation to compensate you.
6. Intellectual Property Rights
6.a.
Except for third-party content as stated in Section 4, all rights, titles, and interests in and to the Mobile Application and its content belong to Kiddos LLC.
6.b.
Unauthorized reproduction, modification, or creation of derivative works is prohibited.
6.c.
This Agreement does not grant you any rights to use the Kiddos Books name, logo, trademarks, or other brand features without prior written consent.
7. Your Information
Kiddos LLC values your privacy and complies with applicable privacy laws, including the CCPA and COPPA.
We do not collect, process, or store personal information, but third-party platforms (like Apple) may collect data subject to their own policies.

8. Parental Controls
Kiddos Books includes parental tools designed to help adults manage access to books and content within the Mobile Application, ensuring an age-appropriate and safe reading experience.
Parents can filter accessible materials, set reading time limits, and curate collections based on individual family needs.
9. Cybersecurity
We do not guarantee that the Mobile Application or any linked websites will be free from viruses or other harmful components.
You are responsible for maintaining your own device security and using appropriate virus protection.
Misuse of the Mobile Application, including introducing harmful material or attempting unauthorized access, is prohibited and may result in suspension, termination, and/or legal action.
10. Subscriptions and Free Trial
10.a. Billing and Cancellation
Users can access a limited selection of free books without a subscription. Access to a broader catalog and premium features requires a paid subscription (monthly or annual), managed via the Apple App Store.
10.b. Availability of Content
Content availability may change over time as Kiddos LLC updates its offerings. Kiddos LLC does not guarantee permanent availability of any specific book or feature.
10.c. Price Changes
We may adjust subscription pricing. We will provide 30 days’ notice prior to any price changes. Continued use after the change constitutes acceptance.
10.d. Refunds and Payment Processing
All payments are processed through Apple. Kiddos LLC cannot issue refunds directly. For refund requests, visit: https://reportaproblem.apple.com.
11. Modification and Discontinuation
Kiddos LLC reserves the right to modify, suspend, or discontinue Kiddos Books at its sole discretion.
In the event of discontinuation, no new subscription charges will be applied, but no refunds will be issued for prior charges.
12. Termination
We reserve the right to suspend or terminate your access if you violate these Terms or if required by law.
13. Disclaimer of Warranties
THE MOBILE APPLICATION IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND.
We make no promises regarding accuracy, reliability, or suitability.
14. Limitation of Liability
To the extent permitted by law, Kiddos LLC’s liability will be limited to the amount you paid for the Mobile Application or $100, whichever is greater.
15. Indemnity
You agree to indemnify and hold harmless Kiddos LLC against any claims or liabilities arising from your use of Kiddos Books.
16. Dispute Resolution
16.a. Mandatory Arbitration
All disputes must be resolved through final and binding arbitration unless you opt out within 30 days of account creation.
16.b. Class and Jury Trial Waivers
Disputes must be brought individually. No class actions or jury trials permitted.
16.c. Severability
If any part of the dispute resolution provision is deemed invalid, the rest remains enforceable.
17. General Terms
17.a. Assignment
You may not assign rights under these Terms. Kiddos LLC may assign its rights.
17.b. Changes to These Terms
We may update these Terms with 30 days’ notice. Continued use of the Mobile Application means acceptance.
17.c. Delay in Enforcing These Terms
Failure to enforce a provision is not a waiver.
17.d. Entire Agreement
These Terms are the entire agreement between you and Kiddos LLC regarding Kiddos Books.
17.e. Governing Law
California law governs these Terms, with disputes subject to courts located in Santa Clara County, California.
