Welcome to Kiddos TV, a sub-product of Kiddos AI, developed and powered by Kiddos LLC. We (“we” or “Kiddos LLC”) are committed to protecting your privacy in compliance with this policy and all applicable state and federal laws. We have a few fundamental principles to ensure transparency and to protect your data:
* We have adopted this policy in an effort to provide our users with full transparency regarding any information collected by the Mobile Application and the purposes for which it is collected. We use the term “collect” to comply with applicable law, this does not imply that we transmit any information about your usage of the Mobile Application to our servers.
* Our goal in publishing this policy is to inform you about our practices and policies regarding the information associated with the Mobile Application so that you may make an informed decision on whether to use the Mobile Application or not.
* We do not and will not sell any information gathered by the Mobile Application to any third party.
* To comply with laws relating to the protection of minors, the Mobile Application utilizes an age gate in a form of a sequential math problem, rather than directly requesting your age.
Our Mobile Application offers filters such as age, language, and categories like kids', teachers', or parents' picks to enhance your browsing experience. These filters are designed to help you find content that best suits your interests and needs, but they are not intended to represent your actual age or identity. We want to emphasize that no information about your usage of the Mobile Application, including your preferences, selected filters, or browsing history, is ever sent to our servers. We do not collect, store, or have access to any such information.
This policy describes:
* The types of information we may collect or that you may provide when you purchase, download, install, register with, access, or use the Kiddos TV application (the “Mobile Application”).
* Our practices for collecting, using, maintaining, protecting, and disclosing that information.
* Our practices concerning children’s Personal Information under the Children’s Online Privacy Protection Act of 1998 (see Section 8)
This policy applies only to information we collect in the Mobile Application and in email and other electronic communications sent through or in connection with the Mobile Application. This policy DOES NOT apply to information that:
* We collect outside the Mobile Application or on any other Kiddos LLC's apps or websites, including websites or third-party content you may access through the Mobile Application.
* You provide to or is collected by any third party. These other third parties may have their own privacy policies, which we encourage you to seek out and read before providing information on or through them.
Please read this policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, do not download, register with, or use the Mobile Application.
By downloading, registering with, or using the Mobile Application, you agree to this privacy policy. If you do not agree to this privacy policy, do not download, register with, or use the Mobile Application. This policy may change from time to time (see Changes to Our Privacy Policy). Your continued use of the Mobile Application after we revise this policy means you accept those changes, so please check the policy periodically for updates.
For the purposes of this policy, any information gathered by the Mobile Application is deemed “collected” even if such information is never sent by the Mobile Application to any remote server or never retrieved or extracted from the device by Kiddos LLC.
# 1. Information We Collect and How We Collect It
We collect information from and about users of our Mobile Application:
* Directly from you when you provide it to us.
* Automatically when you use the Mobile Application.
Unless explicitly stated otherwise in this policy, Kiddos LLC does not intentionally retrieve or extract data from your device. Additionally, no identifiable user data is transmitted by the Mobile Application to any remote server owned or controlled by Kiddos LLC.
## 1.a. Kinds of Information We Collect
* Feedback and reports concerning videos or ads that may be inappropriate, or about technical problems with the Mobile Application or integration of third-party content. These reports may include information relevant to Apple or third-party content providers, like device type or operating system version.
* We may keep records and copies of your correspondence (including email) if you contact us in connection with the Mobile Application or send feedback through the Mobile Application. We may also ask you for information when you report a problem with the Mobile Application.
If you have intentionally provided false information, we request that you cease using the Mobile Application immediately.
If you do not want us to collect the above categories of information, do not download the Mobile Application or delete it from your device.
# 2. How We Use Your Information
We use information that you provide to us or that we collect about you:
* To provide you with the Mobile Application and its contents, and any other information, products, or services that you request from us.
* To develop or improve our products.
* In any other way we may describe when you provide the information.
* For any other purpose with your consent.
* To carry out our obligations and enforce our rights, including those arising from contracts entered into between you and us.
* To comply with relevant laws.
# 3. Disclosure of Your Information
We don’t sell any of your personal information. We also don’t “share” your personal information, as defined in the California Consumer Privacy Act (“CCPA”).
We may disclose personal information that we collect or that you provide as described in this privacy policy in the following circumstances:
* To fulfill the purpose for which you provide it.
* To contractors, service providers, and other third parties who need the information to perform services on our behalf and are bound by contractual obligations to keep your personal information confidential and use it only for the purposes for which we disclose it to them.
* In the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Kiddos LLC’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by Kiddos LLC about users of the Mobile Application is among the assets transferred.
* With your explicit consent.
* To comply with any court order, law, or legal process, including to respond to any government or regulatory request.
* To enforce or apply our Terms of Use and other agreements, including for billing and collection purposes.
* If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of Kiddos LLC, our customers, or others.
* For any other purpose disclosed by us when you provide the information.
# 4. Third Party Content and Advertising
The Mobile Application may link to or display content from third parties, including YouTube. These third parties may use tracking technologies to collect information about you when you consume or visit third-party content. The information they collect may be associated with your personal data, including details about your online activities across websites and services. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content. We encourage you to review and agree to the **YouTube Privacy Policy** (https://policies.google.com/privacy) to understand how your data is handled by YouTube.
Kiddos TV does not engage in behavioral tracking or collect personal information for the purpose of targeted advertising. Any advertisements shown within the Mobile Application are contextually based on the content being viewed and are not personalized to individual users. We prioritize child privacy and safety, ensuring that no data is collected or used to create personalized profiles or to deliver behavioral advertisements.
These third parties may provide you with options to opt out of interest-based advertising. For example, you can opt out of receiving targeted ads from members of the Network Advertising Initiative (“NAI”) by visiting the NAI’s website and following the instructions provided.
Please note that opting out of interest-based advertising does not mean you will not receive any advertisements. Instead, the ads you receive may be less relevant to your interests.
# 5. Data Security
Unfortunately, the storage and transmission of information digitally, including via the internet, is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of the personal information you share with us. Any sharing or transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Mobile Application.
We are not responsible for the privacy and security practices of any third parties.
We are not liable for any loss, damage or claim arising out of another person’s use of the personal information where we were authorized to provide that person with the personal information.
# 6. Accessing and Correcting Your Information
You may update your personal information from within the Mobile Application to ensure it is accurate and complete. In addition, if you no longer wish to use the Mobile Application or wish to delete all data associated with it, you can delete the Mobile Application from your device. When the Mobile Application is deleted from your device using the built-in iOS feature, all locally stored data will also be deleted. This deletion process is handled entirely on your device, and no additional data is transmitted or stored on any remote servers by Kiddos LLC.
You are responsible for ensuring that any information you provide, such as feedback or reports, is accurate and truthful. Kiddos LLC and its affiliates will not be liable for any consequences arising from inaccurate or untruthful information provided by users.
If you wish to ensure that any residual data associated with third-party services, such as YouTube content accessed through the app, is also deleted, please follow the deletion procedures provided by those third-party services.
# 7. Your State Privacy Rights
State consumer privacy laws may provide their residents with additional rights regarding our use of their personal information. Depending on where you live and subject to certain exceptions, you may have some or all of the following rights:
* The right to know whether we have collected, sold, shared, or disclosed for a business purpose, your personal information, that provides specific details.
* The specific pieces of personal information we collected.
* The right to delete personal information.
* The right to correct inaccurate personal information.
* The right to opt out of the processing of your personal information obtained from your activities on nonaffiliated websites or online applications for the purposes of targeted advertising.
* The right not to receive discriminatory treatment for exercising your privacy rights.
# 8. Children’s Personal Information: Children’s Online Privacy Protection Act of 1998 (COPPA)
Kiddos LLC does not directly collect, use, or disclose children’s Personal Information as defined by the Children’s Online Privacy Protection Act of 1998, also known as “COPPA”.
However, in order to provide the Mobile Application, Kiddos LLC relies on third parties that may collect, maintain, or disclose children’s Personal Information. A list of these third parties can be found in Section 9.
Parents should contact these operators using the provided contact information concerning requests to modify, delete, or cease disclosure of any Personal Information they may have collected.
Users can stop further collection by these parties through the Mobile Application by uninstalling the Mobile Application and deleting their account.
# 9. Parental Consent and Age Verification
In compliance with the Children’s Online Privacy Protection Act (COPPA) and applicable laws, Kiddos LLC requires verifiable parental consent for children under the age of 13 before collecting, using, or disclosing any personal information. By agreeing to the Kiddos TV Terms of Use, parents or guardians confirm that they consent to their child’s use of the Mobile Application and any associated data collection practices, as described in this policy.
We rely on parental consent to ensure the protection of children’s data and encourage parents to actively monitor their child’s use of the Mobile Application. If you believe that personal information has been collected from your child without your consent, please contact us immediately at contact@kiddos.ai, and we will take prompt action to delete such information and deactivate the account if necessary.
